Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "user," or "visitor") and OhShie ("OhShie," "we," "us," or "our"), operated by OhShie, contactable at hello@ohshie.app, governing your access to and use of the website at ohshie.app and all related services, features, and content (collectively, the "Service").

PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE SERVICE. BY ACCESSING THE WEBSITE, CREATING AN ACCOUNT, OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS AND OUR PRIVACY POLICY. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT USE THE SERVICE.

OhShie is a social platform that permits adult content, including nudity. If you are not comfortable with such content, do not use the Service.

Definitions

• "Service" or "Platform" — The website at ohshie.app, including all pages, features, content, and related services
• "Provider" — OhShie, the operator of the Service, contactable at hello@ohshie.app
• "Visitor" — Any person who accesses or browses the Service without creating an account. Visitors are bound by these Terms to the extent applicable
• "User" — Any person who has registered for an account on the Service. Users have access to additional features such as posting, liking, commenting, and following
• "User Content" — Any content uploaded, posted, or submitted to the Service by a User, including images, captions, comments, and profile information
• "Coins" — Virtual currency awarded through the leaderboard system with no real-world monetary value

1. Eligibility and Age Requirement

YOU MUST BE AT LEAST 18 YEARS OLD TO ACCESS OR USE THE SERVICE.

By creating an account, you represent and warrant that:

• You are at least 18 years of age
• The date of birth you provide during registration is accurate and truthful
• You have the legal capacity to enter into a binding agreement
• You are not barred from using the Service under the laws of your jurisdiction
• You have explicitly accepted these Terms of Service and our Privacy Policy during the registration process by checking the required consent checkbox. We record the date and time of your acceptance

We enforce a minimum age of 18 because the Service permits content that may include nudity and adult material. Providing a false date of birth to circumvent this restriction is a violation of these Terms and will result in immediate account termination.

If we have reason to believe that a user is under 18, we will immediately suspend or terminate their account and delete all associated data.

2. Account Registration and Security

To use certain features of the Service, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information (including your true date of birth)
• Maintain and update your information to keep it accurate
• Keep your password secure and confidential. Do not share your credentials with anyone
• Notify us immediately at hello@ohshie.app if you suspect unauthorized access to your account
• Maintain only one account per person. Creating multiple accounts (including to evade bans or manipulate the leaderboard) is prohibited

You are solely responsible for all activity that occurs under your account, whether or not you authorized it. We are not liable for any loss or damage arising from unauthorized use of your account.

We reserve the right to reject, remove, or reclaim any username at our sole discretion, including usernames that are offensive, misleading, infringe on trademarks, impersonate others, or are otherwise inappropriate.

The following content is strictly prohibited on OhShie. Violation of these rules will result in immediate content removal and may result in permanent account termination and reporting to law enforcement:

OhShie permits certain adult content, including nudity, subject to the following rules:

By uploading adult content, you represent and warrant that all persons depicted are at least 18 years old and have given their explicit consent to the creation and sharing of such content. You are solely responsible for verifying and maintaining records of such consent.

6. Acceptable Use Policy

In addition to the content rules above, you agree not to:

• Use bots, scripts, crawlers, scrapers, or other automated means to access the Service or collect data from it
• Attempt to gain unauthorized access to any part of the Service, other users' accounts, or any systems or networks connected to the Service
• Circumvent, disable, or interfere with security-related features, including CAPTCHA verification, rate limiting, and age verification
• Create multiple accounts, including to evade bans, manipulate the leaderboard, or inflate follower/like counts
• Engage in any activity that artificially inflates engagement metrics (likes, follows, leaderboard positions), including purchasing or exchanging follows/likes
• Use the Service to send spam, chain letters, or unsolicited promotions
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service in violation of any applicable local, state, national, or international law

7. Leaderboard, Coins, and Rewards

OhShie features a leaderboard ranking system and a virtual currency ("Coins") rewarded to top-performing users. You acknowledge and agree that:

• Coins are virtual items with no real-world monetary value. They cannot be exchanged, cashed out, or transferred for real currency
• Coins may be used to purchase in-app customization items (such as profile skins or borders)
• Leaderboard positions are calculated based on the number of likes received on posts within a given time period and may be segmented by content category
• We reserve the right to modify, suspend, or discontinue the leaderboard and Coins system at any time without notice or compensation
• We reserve the right to revoke Coins or reset leaderboard positions if we determine, in our sole discretion, that they were obtained through manipulation, fraud, or violation of these Terms

8. Referral Program

OhShie may offer a referral program that allows you to invite others to join the Service. By participating, you agree:

• Not to spam or send unsolicited referral links
• Not to create fake accounts to generate referral conversions
• Not to use deceptive tactics to encourage clicks or sign-ups
• That we may track referral clicks and conversions using cookies and session identifiers, as described in our Privacy Policy
• That we may terminate your participation in the referral program at any time and revoke any rewards obtained through fraudulent means

9. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of OhShie. This includes, but is not limited to, the OhShie name, logo, visual design, source code, and all related trademarks and trade dress.

You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you reverse engineer or attempt to extract the source code of any software that comprises the Service, unless such restrictions are prohibited by law or you have our written permission.

10. Copyright Infringement and DMCA

We respect the intellectual property rights of others and expect our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond to valid notices of alleged copyright infringement.

11. Content Moderation and Enforcement

We reserve the right, but are not obligated, to review, monitor, edit, or remove any User Content at our sole discretion and for any reason, including but not limited to content that we determine violates these Terms, is objectionable, or poses a risk to the safety of any person.

We do not pre-screen all content and cannot guarantee that we will detect or remove all prohibited content in a timely manner. We rely in part on user reports to identify content that violates these Terms. We are not liable for any content posted by users.

Enforcement actions may include, at our discretion: content removal, account warnings, temporary suspension, permanent account termination, and reporting to law enforcement where legally required.

12. Reporting and Safety

If you encounter content or behavior that violates these Terms, you can report it through:

• The in-app report feature on posts and profiles

For urgent safety matters, including suspected CSAM, immediate threats of violence, or non-consensual intimate images, please also contact local law enforcement.

We take all reports seriously and will review them in a timely manner. Where required by law, we will report suspected CSAM to the National Center for Missing & Exploited Children (NCMEC) and cooperate with law enforcement investigations.

13. Third-Party Services

The Service integrates with and relies on the following third-party services:

• Google — For OAuth authentication
• Supabase — For database, authentication, and file storage infrastructure
• Vercel — For hosting and analytics
• Cloudflare — For security and CAPTCHA verification

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the availability, accuracy, or practices of any third-party services. Links to third-party sites do not imply endorsement.

14. Privacy

Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, store, and protect your personal data. The Privacy Policy is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in the Privacy Policy.

15. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Without limiting the foregoing, we do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free
• The information, content, or materials on the Service are accurate, reliable, or complete
• Defects in the Service will be corrected
• The Service or the servers that make it available are free of viruses or other harmful components

You acknowledge that you may encounter User Content that you find offensive, indecent, objectionable, or that includes nudity or adult material. You access such content at your own risk, and we are not liable for User Content posted by others.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL OHSHIE, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to, use of, or inability to access or use the Service
• Any conduct or content of any third party on the Service, including any defamatory, offensive, or illegal conduct of other users
• Any User Content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

In jurisdictions that do not allow the exclusion or limitation of certain warranties or liabilities, our liability shall be limited to the maximum extent permitted by applicable law.

You agree to indemnify, defend, and hold harmless OhShie and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

• Your access to or use of the Service
• Your User Content
• Your violation of these Terms
• Your violation of any third-party right, including any intellectual property, privacy, or publicity right
• Any claim that your User Content caused damage to a third party

If you have a dispute with OhShie, we encourage you to contact us first at hello@ohshie.app to attempt to resolve it informally.

These Terms shall be governed by and construed in accordance with the laws applicable in your jurisdiction of residence, without regard to conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts of competent jurisdiction in your place of residence.

Nothing in this section limits your rights as a consumer under applicable mandatory consumer protection laws, including the right to bring proceedings in your local courts.

20. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by:

• Posting the updated Terms on this page with a new effective date
• Providing notice through the Service (such as an in-app notification) or via email

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Service and delete your account.

21. Service Modifications

We reserve the right to modify, update, suspend, or discontinue any part of the Service (including features, functionality, design, and content) at any time, with or without notice, for any reason. This includes changes to the leaderboard system, Coins, customization items, referral program, and any other features.

We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service or any part thereof.

22. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the parties' original intent.

23. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and OhShie regarding your use of the Service, and supersede all prior agreements, representations, and understandings. No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.
